This Privacy Policy describes how Girikon AI Inc. (“Girikon,” “we,” “our,” or “us”) collects, uses, discloses, and protects information in connection with GirikVoice, its voice and AI-powered customer engagement product (the “Service”).

This Privacy Policy applies to customers who subscribe to the Service, authorized users, and individuals whose information is processed through the Service.

1. Scope of This Policy

GirikVoice is designed for business use and operates as an integrated service with customer systems such as HubSpot. This Privacy Policy governs data processed through the Service and does not apply to third-party platforms governed by their own privacy policies.

2. Roles and Responsibilities

For the purposes of applicable data protection laws:

  • Customers act as Data Controllers and determine the purposes and means of processing Personal Data.
  • Girikon acts as a Data Processor, processing Personal Data solely on documented instructions from the Customer.

3. Information We Process

3.1 Information from Customer Systems

When Customers connect GirikVoice to HubSpot or other supported systems, we may process:

  • Contact and company records
  • Call activities and engagement data
  • User and owner identifiers
  • Custom CRM properties related to voice interactions

3.2 Voice and AI Interaction Data

When voice or AI features are enabled, we may process:

  • Phone numbers
  • Call metadata (such as time, duration, and direction)
  • Call recordings (where enabled)
  • Call transcripts and AI-generated summaries
  • Intent, sentiment, and call outcome data

3.3 Information We Do Not Collect

We do not collect:

  • Payment card or banking information
  • Sensitive personal data unless explicitly provided by the Customer
  • Data for advertising or behavioral profiling

4. Legal Basis for Processing

We process Personal Data only where permitted by law, including:

  • Processing necessary for the performance of a contract
  • Processing based on Customers’ instructions and configurations
  • Legitimate interests related to operating and improving the Service
  • Consent, where required by applicable law

Customers are responsible for obtaining any required consent from end users, including consent for call recording.

5. Use of Information

We process Personal Data for the following purposes:

  • Providing and operating the Service
  • Enabling voice calls and AI voice agents
  • Recording, transcribing, and summarizing calls
  • Logging call activity and insights into customer systems
  • Improving call quality, analytics, reporting, and automation
  • Supporting customer service and technical operations

6. Automated Processing and Artificial Intelligence

The Service uses artificial intelligence to analyze calls and generate insights, including transcripts, summaries, and sentiment analysis

AI-generated outputs are intended to assist users and do not constitute fully automated decision-making with legal or similarly significant effects.

7. Disclosure of Information

We disclose Personal Data only to:

  • Customer-authorized platforms, including HubSpot
  • Telephony service providers
  • AI and analytics service providers
  • Cloud infrastructure and hosting providers

All third parties are contractually obligated to process data only for authorized purposes and to maintain appropriate security measures.

8. International Data Transfers

Personal Data may be transferred to and processed in countries other than the Customer’s country of residence. Where required, such transfers are subject to appropriate safeguards, including Standard Contractual Clauses or other lawful transfer mechanisms.

9. Data Ownership and Control

Customers retain all rights, title, and interest in Personal Data processed through the Service. Access to Customer systems may be revoked at any time through platform settings or by contacting support.

10. Data Security

We implement reasonable and appropriate technical and organizational measures to protect Personal Data, including:

  • Encryption of data in transit and at rest
  • Secure cloud environments
  • Role-based access controls
  • Monitoring and audit logging

11. Data Retention

We retain Personal Data only for as long as necessary to provide the Service or as instructed by the Customer. Data may be deleted or anonymized upon Customer request, subject to legal obligations.

12. Data Breach Notification

In the event of a personal data breach affecting Customer data, we will notify the Customer without undue delay and provide information necessary to support compliance with applicable laws.

13. Individual Rights

Where applicable, individuals may have the right to request:

  • Access to their Personal Data
  • Correction or deletion of Personal Data
  • Restriction or objection to processing
  • Data portability

14. Children’s Information

The Service is not intended for use by individuals under the age of 16, and we do not knowingly process children’s Personal Data.

15. Compliance

The Service is designed to support compliance with applicable data protection laws, including:

  • California Consumer Privacy Act (CCPA) and CPRA
  • HubSpot Marketplace privacy requirements
